Digital Millennium Copyright Act (DMCA) Compliance

GoWithND Inc. respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for addressing claims of copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA) and the Canadian Copyright Act’s notice-and-notice regime.

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been infringed upon on our website, you must submit a written notification that includes the following six (6) elements as required by 17 U.S.C. § 512(c)(3):

1. Physical or Electronic Signature: A signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the Copyrighted Work: A description of the copyrighted work claimed to have been infringed. If multiple works are covered, a representative list is acceptable.
3. Identification of Infringing Material: Identification of the material that is claimed to be infringing, with sufficient detail to enable us to locate it (e.g., specific URLs).
4. Contact Information: Your name, address, telephone number, and email address so we can contact you.
5. Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. Accuracy Statement: A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Counter-Notification Procedure

If you believe that material you posted was removed or access was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include:

1. Your physical or electronic signature
2. Identification of the material that was removed or disabled and its prior location
3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
4. Your name, address, and telephone number
5. A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Ontario, Canada, if outside the US)
6. A statement that you will accept service of process from the person who filed the original notice

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, GoWithND maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We reserve the right to terminate user access at our discretion for even a single instance of infringement if circumstances warrant.

Canadian Copyright Act — Notice-and-Notice Compliance

In addition to DMCA compliance, we adhere to Canada’s notice-and-notice regime under the Copyright Act. Upon receiving a notice of claimed infringement that complies with the statutory requirements, we will:

• Forward the notice to the alleged infringer within the required timeframe
• Retain records of the notice as required by law
• Not disclose the identity of the notice sender without a court order, unless required by law

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to this page. We encourage you to review this policy periodically.
